It is hard to see how any objective viewer could see the the action of Zdeno Chara’s forearm driving Max Paciorety’s head against the post holding the plexiglass plate above the boards as anything other than intentional. The action resulted in life threatening injury and yet the NHL took the position that it was just an unfortunate incident which occurred in the ‘heat of the action’. It would be interesting to see a jury decide, after watching the video in slow motion a few times, whether this was ‘part of the game’ and whether any sane person would consent to the application of this level of violence in the course of a professional sporting contest. Even if a person did consent, it would be nullified accoring to the Supreme Court Of Canada’s decision in the case of R. v. Jobidon
