The Supreme Court has once again reaffirmed the distinction between the principals of private law and those governing the criminal law. In a unanimous decision the court upheld the right of superior officials to review and ultimately cancel a written plea agreement whereby a prosecutor had accepted to drop criminal charges in return for a guilty plea to a provincial traffic offence. It is worth noting in the result the accused person was returned to the position she was in before the agreement, without having lost any rights or defences.
